Rental deposits in France: amount, return and penalties

The deposit covers unpaid rent or damage. For a main-residence let, French law sets the maximum amount and the deadline for returning it.

Maximum amount

Type of letMaximum
Unfurnished1 month’s rent excluding charges
Furnished (including student lease)2 months’ rent excluding charges
Mobility leaseNot allowed

The amount must appear in the lease. It cannot be revised during the tenancy or at renewal.

Return deadline

The deadline runs from the return of the keys:

  • 1 month if the check-out inventory matches the check-in one;
  • 2 months if there are differences, in which case the landlord may keep justified amounts (repairs, unpaid rent or charges).

Deductions must be backed by invoices, quotes or reports. Normal wear and tear cannot be deducted.

If it is late

If the deposit is not returned on time, the amount due is increased by 10% of the monthly rent excluding charges for each month of delay started. First send a formal notice by registered letter; if that fails, the departmental conciliation commission can be approached free of charge, before going to court.

Help paying the deposit

Action Logement offers, subject to conditions, an advance to fund the deposit. Your department’s housing solidarity fund (FSL) may also grant a loan or subsidy.

Key points

  • 1 month unfurnished, 2 months furnished, none under a mobility lease.
  • Return within 1 month, or 2 months with justified deductions.
  • Late return: +10% of monthly rent per month started.
